Terms of Service

Birbol provides a managed, self-hosted business stack that may include:

• A high-performance website (Astro + Strapi CMS)
• CRM with AI integration (Twenty)
• Appointment scheduling
• Invoicing and payment processing
• Server hosting and infrastructure management
• Ongoing maintenance, updates, and support
• Custom application development as needed

The specific services included in your engagement are defined in your signed proposal or service agreement.

Setup fee. A one-time setup fee is due before work begins. The amount is specified in your proposal.

Monthly management. After setup, a recurring monthly fee covers hosting, maintenance, updates, and support. This fee is billed on the first of each month.

Payment terms. Invoices are due within 30 days of issue (net-30). I accept bank transfer and major credit cards.

Late payments. If payment is more than 30 days overdue, I reserve the right to suspend services after providing written notice and a 7-day grace period.

Your data is yours. All data stored on your server — CRM records, website content, customer information, analytics — belongs to you. I will never claim ownership of your data.

Your stack runs on infrastructure provisioned for you. I manage it on your behalf, but you retain full ownership and can request a complete data export at any time.

I will never sell, share, or use your data for any purpose other than providing the services you've contracted for.

Your content. You own all content you create or provide — text, images, branding, customer data. I claim no rights to any of it.

System architecture. I retain intellectual property rights over the Birbol system architecture, deployment configurations, custom integrations, and tooling that make up the platform. This is the "how it works" — not your data or content.

Open source components. The open-source tools in your stack (Astro, Strapi, Twenty, etc.) are governed by their respective licenses (AGPL, MIT, Apache 2.0). I provide source code access per those license requirements.

Scheduled maintenance windows will be communicated at least 48 hours in advance and performed during low-traffic hours.

Service may be interrupted due to factors outside my control (upstream provider outages, force majeure, etc.), but I will respond to issues promptly and keep you informed.

To the maximum extent permitted by law, Birbol's total liability for any claim arising from these services is limited to the total fees you've paid in the 3 months preceding the claim.

I am not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption — except where caused by gross negligence or willful misconduct.

I maintain regular server backups and take reasonable precautions to protect your data, but I recommend you keep independent backups of critical business information.

By you. You may cancel your service at any time with 30 days' written notice. I'll provide a complete data export in standard formats and assist with migration if needed.

By me. I may terminate service with 30 days' written notice if you breach these terms, fail to pay after the grace period, or use services for prohibited purposes. In case of termination, I'll still provide your data export.

After termination. Your server and data will be preserved for 30 days after the effective termination date to allow for migration. After that period, the server and all data will be securely deleted.

If a dispute arises, let's try to resolve it like adults — by talking about it. Email me and I'll work with you to find a fair solution.

If it can't be resolved directly, these terms are governed by the laws of the State of South Carolina. Any legal proceedings shall be brought in the courts of Greenville County, SC.
